American Colgate defends its copyright in Uzbekistan
The Antimonopoly Committee considered the appeal of the American Colgate-Palmolive Company on the violation of its intellectual property rights by the Uzbek LLC Torimed Pharm. This is reported on the Committee’s Telegram-channel.
The American company in its appeal indicated that the Uzbek manufacturer imitates the appearance of its products.
The Colgate-Palmolive Company makes toothpaste under combined trademarks using the word Colgate. The LLC Torimed Pharm also produces toothpaste and in 2016 received a certificate for the verbal trademark Galaxy, Galaksi.
However, design of the color scheme and packaging of toothpaste with the Galaxy trademark, as well as other elements imitate the appearance of similar products manufactured by the Colgate-Palmolive Company.
This contributes to the fact that consumers are misled about the manufacturers of these toothpastes.
As the fact of a violation leading to unfair competition was confirmed, the Antimonopoly Committee opened a case against the LLC Torimed Pharm.
As a result of the review, the LLC Torimed Pharm was issued an order to eliminate the fact of violation by stopping the sale of its products, as well as to destruct packages that are in the company's warehouses. The order also indicates withdrawal of Galaxy toothpaste from circulation.
